Welcome to ChoosePure ("ChoosePure", "we", "our", "us"). By accessing our website, joining the ChoosePure community, contributing towards food testing, purchasing a subscription, or using any of our services, you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, please do not use ChoosePure.

These Terms should be read alongside our Privacy Policy and Refund Policy.

1. Nature of ChoosePure Services

ChoosePure is an independent, community-driven consumer awareness platform dedicated to food quality, purity, nutrition, and processing transparency. We operate without brand sponsorship or commercial influence from any food manufacturer.

• All testing is facilitated through NABL-accredited laboratories following FSSAI, FDA, and EFSA protocols and methodologies.
• We share lab reports and simplified insights to help consumers make informed choices about the food they consume.
• ChoosePure does not manufacture, sell, distribute, or endorse any food product.
• ChoosePure acts solely as an intermediary between consumers and accredited testing laboratories, funded entirely by community contributions and subscriptions.
• No brand, manufacturer, or commercial entity has any editorial control or sponsorship influence over our testing process, results, or publications.

2. Laboratory Testing & Reports

By using ChoosePure, you expressly acknowledge and agree that:

• All food testing is conducted in NABL-accredited laboratories using standard procedures aligned with FSSAI, FDA, and EFSA protocols.
• The reports shared by ChoosePure are exactly as provided by the laboratory, without any alteration of test results.
• Testing is sample-based. ChoosePure does not guarantee or warrant that the lab results represent absolute or universal product quality, as:
  • Results may vary across batches, locations, and time
  • Different laboratories may produce marginally different results for the same sample
  • A single test reflects the specific sample tested and not the entire product line
• The reports are informational and educational only, and should not be treated as medical, nutritional, legal, or regulatory advice.
• ChoosePure does not claim that any product is safe or unsafe based solely on a single test report. Our reports are not a substitute for official regulatory action by FSSAI or any other authority.

3. Report Access, Sharing & Permitted Use UPDATED

3.1 Full Lab Reports

Full laboratory reports, including detailed test parameters, raw data, and comprehensive analysis, are available exclusively to ChoosePure members (paid subscribers and qualifying contributors). Full reports are provided for personal, non-commercial use only.

• Copy, reproduce, or duplicate full reports (in whole or in part) for commercial purposes
• Publish full reports on any website, blog, or media outlet without prior written consent from ChoosePure
• Redistribute, resell, or forward full reports to third parties
• Use reports to defame, mislead, or misrepresent any brand or product
• Present ChoosePure reports as official regulatory or government findings

3.2 Summary Reports

Summary reports, including simplified scores, key findings, and visual summaries, are freely accessible and may be shared publicly, provided:

• The content is not altered, cropped misleadingly, or taken out of context
• Proper attribution to ChoosePure is clearly given (e.g., "Source: ChoosePure – choosepure.in")
• No commercial gain is derived from such sharing
• The shared content links back to the original ChoosePure report page where possible

Unauthorised sharing or misuse of reports may result in immediate suspension of your account, revocation of access, and legal action including claims for damages.

4. Publication in Public Interest NEW

ChoosePure reserves the right to publish test results, summaries, and insights in the public interest. This right is exercised in accordance with the following principles:

4.1 Legal Basis

Publications are made in reliance on the Consumer Protection Act, 2019 and the Food Safety and Standards Act, 2006, which recognise the right of consumers and consumer organisations to access and disseminate information about product quality and safety. ChoosePure's publications constitute fair comment on matters of public interest.

4.2 Scope of Publication

ChoosePure may publish, without limitation:

• Products that fail to meet FSSAI standards or declared label claims
• Aggregated or anonymised data trends for consumer education
• Comparative analyses across product categories
• Alerts regarding potential adulteration, contamination, or misleading labelling

4.3 Good Faith & No Malice

Where a publication identifies specific products or brands, it is based on factual laboratory findings and does not constitute a personal attack, defamation, or unfair trade practice.

5. Product Scores & Ratings Disclaimer

ChoosePure may provide scores, ratings, or simplified summaries for tested products. By using these, you acknowledge that:

• Scores are generated using ChoosePure's proprietary scoring methodology and are provided for consumer understanding and educational purposes only.
• The scores reflect an overall assessment based on purity indicators, nutritional parameters, degree of processing, and compliance with declared label claims.
• The scoring system is defined by ChoosePure, inspired by publicly known frameworks, but is not an official regulatory certification and should not be treated as one.
• ChoosePure does not claim that scores are correct, complete, or applicable in all cases.
• Scores should not be interpreted as endorsements, rejections, or guarantees of any product.
• Scores may be updated as new data becomes available or methodology is refined.

6. Brand & Third-Party Dispute Procedure NEW

ChoosePure is committed to fairness and accuracy. If any brand, manufacturer, or third party believes that a report, score, or publication is inaccurate or unfair, the following procedure applies:

Important: During the dispute process, ChoosePure may, at its sole discretion, temporarily remove or flag the disputed content pending resolution. Frivolous or bad-faith disputes may be dismissed without further review.

7. Subscriptions & Payments

7.1 Billing Cycles

ChoosePure offers both monthly and annual subscription plans. Subscriptions provide access to premium features including full lab reports, early access to test results, and community features. Subscription details, pricing, and benefits are listed on our website.

7.2 Community Contributions

Contributions made towards food testing are voluntary, community-driven, and non-refundable. These contributions fund the testing process and are not payments for a specific product or guaranteed outcome. All payments are processed through secure third-party payment gateways in Indian Rupees (INR), inclusive of applicable taxes unless stated otherwise.

7.3 Price Changes

ChoosePure reserves the right to modify subscription pricing. Any price changes will be communicated to existing subscribers with a minimum of 30 days' prior notice before the change takes effect. Continued use of the platform after the price change constitutes acceptance of the new pricing.

7.4 Auto-Renewal & Cancellation

Subscriptions auto-renew at the end of each billing cycle unless cancelled before the renewal date. You will be notified before any renewal charge is processed. Refunds, if any, are subject to ChoosePure's Refund Policy.

8. User Responsibilities

By using ChoosePure, you agree to:

• Use the platform for lawful and personal purposes only
• Provide accurate information while registering or contributing
• Not misrepresent ChoosePure reports as official regulatory or government findings
• Not use ChoosePure content to defame, mislead, or misrepresent any brand, product, or individual
• Not attempt to reverse-engineer, scrape, crawl, or extract data from the platform through automated means
• Not harass, abuse, or threaten other community members or ChoosePure staff
• Comply with all applicable local, state, and national laws while using the platform

9. Intellectual Property

• All content, summaries, scoring frameworks, explanations, visual designs, and branding on ChoosePure are the intellectual property of ChoosePure.
• The ChoosePure name, logo, and associated marks are trademarks of ChoosePure.
• Unauthorised use, reproduction, or distribution is strictly prohibited.
• Raw laboratory data and factual test results are treated as factual information. ChoosePure's intellectual property extends to the presentation, analysis, scoring, and commentary built upon that data.
• Users retain ownership of any content they submit (e.g., product suggestions, community comments), but grant ChoosePure a non-exclusive, royalty-free, perpetual licence to use, display, and distribute such content on the platform.

10. Indemnification NEW

You agree to indemnify, defend, and hold harmless ChoosePure, its founders, employees, partners, and affiliates from and against any and all claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from:

• Your use or misuse of the platform or its content
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• Any content you submit, share, or distribute through or from the platform
• Any unauthorised sharing, redistribution, or commercial exploitation of reports
• Any claims brought by third parties as a result of your actions on or related to the platform

11. Limitation of Liability

ChoosePure shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from:

• Use of or reliance on reports, scores, or any content on the platform
• Product purchase decisions made based on ChoosePure content
• Differences in future product quality, composition, or formulation
• Interruption, suspension, or termination of services
• Unauthorised access to or alteration of your data

Users assume full responsibility for decisions made based on ChoosePure content. Our total liability, if any, shall not exceed the amount paid by you to ChoosePure in the 12 months preceding the claim.

12. Termination of Access

ChoosePure reserves the right to suspend or terminate user access without prior notice, remove or restrict content, and revoke report access and community privileges if:

• These Terms are violated
• ChoosePure determines, at its sole discretion, that continued access poses a risk to the platform, its users, or third parties
• A user engages in fraudulent, abusive, or unlawful activity

Upon termination, your right to access the platform and its content ceases immediately. Provisions that by their nature should survive termination — including Sections 9 (Intellectual Property), 10 (Indemnification), 11 (Limitation of Liability), 13 (Dispute Resolution & Arbitration), and 14 (Governing Law & Jurisdiction) — shall remain in effect.

13. Dispute Resolution & Arbitration NEW

In the event of any dispute, controversy, or claim arising out of or relating to these Terms or the use of ChoosePure:

13.1 Good-Faith Negotiation

The parties shall first attempt to resolve the dispute informally by contacting support@choosepure.in. Both parties agree to negotiate in good faith for a period of 30 days from the date of the initial written notice.

13.2 Mandatory Arbitration

If good-faith negotiation fails, the dispute shall be resolved by binding arbitration in accordance with the Arbitration and Conciliation Act, 1996 (India). The arbitration shall be conducted in Bengaluru, India, in the English language, by a sole arbitrator mutually appointed by the parties. If the parties cannot agree on an arbitrator within 15 days, the appointment shall be made in accordance with the Act.

13.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action or class-wide arbitration against ChoosePure.

14. Governing Law & Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of India. Subject to the arbitration clause in Section 13, any disputes shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.

15. Changes to These Terms

ChoosePure may update these Terms from time to time. When we make changes:

• The updated Terms will be posted on this page with a revised effective date.
• For material changes, we will provide a minimum of 14 days' notice via email or an in-app notification before the changes take effect.
• Continued use of the platform after the effective date of any changes constitutes your acceptance of the revised Terms.
