Welcome to ChoosePure ("ChoosePure", "we", "our", "us"). By accessing our website, joining the ChoosePure community, contributing towards food testing, purchasing a subscription, or using any of our services, you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, please do not use ChoosePure.

These Terms should be read alongside our Privacy Policy and Refund Policy.

1. Nature of ChoosePure Services

ChoosePure is an independent, community-driven consumer awareness platform dedicated to food quality, purity, nutrition, and processing transparency. We operate without brand sponsorship or commercial influence from any food manufacturer.

By using ChoosePure, you expressly acknowledge and agree that:

3.1 Full Lab Reports

Full laboratory reports, including detailed test parameters, raw data, and comprehensive analysis, are available exclusively to ChoosePure members (paid subscribers and qualifying contributors). Full reports are provided for personal, non-commercial use only.

4. Publication in Public Interest NEW

ChoosePure reserves the right to publish test results, summaries, and insights in the public interest. This right is exercised in accordance with the following principles:

Publications are made in reliance on the Consumer Protection Act, 2019 and the Food Safety and Standards Act, 2006, which recognise the right of consumers and consumer organisations to access and disseminate information about product quality and safety. ChoosePure's publications constitute fair comment on matters of public interest.

All publications are made in good faith, based on verified laboratory data from NABL-accredited facilities, and are intended solely to promote transparency and consumer welfare. ChoosePure does not act with malice towards any brand or manufacturer.

Where a publication identifies specific products or brands, it is based on factual laboratory findings and does not constitute a personal attack, defamation, or unfair trade practice.

5. Product Scores & Ratings Disclaimer

ChoosePure may provide scores, ratings, or simplified summaries for tested products. By using these, you acknowledge that:

ChoosePure is committed to fairness and accuracy. If any brand, manufacturer, or third party believes that a report, score, or publication is inaccurate or unfair, the following procedure applies:

4. Retraction Policy If the dispute is upheld, ChoosePure will update or retract the relevant content and notify affected users. If not upheld, ChoosePure will provide a written explanation of its findings Within 7 business days of resolution

Important: During the dispute process, ChoosePure may, at its sole discretion, temporarily remove or flag the disputed content pending resolution. Frivolous or bad-faith disputes may be dismissed without further review.

7. Subscriptions & Payments

7.1 Billing Cycles

ChoosePure offers both monthly and annual subscription plans. Subscriptions provide access to premium features including full lab reports, early access to test results, and community features. Subscription details, pricing, and benefits are listed on our website.

7.2 Community Contributions

Contributions made towards food testing are voluntary, community-driven, and non-refundable. These contributions fund the testing process and are not payments for a specific product or guaranteed outcome. All payments are processed through secure third-party payment gateways in Indian Rupees (INR), inclusive of applicable taxes unless stated otherwise.

7.3 Price Changes

ChoosePure reserves the right to modify subscription pricing. Any price changes will be communicated to existing subscribers with a minimum of 30 days' prior notice before the change takes effect. Continued use of the platform after the price change constitutes acceptance of the new pricing.

7.4 Auto-Renewal & Cancellation

Subscriptions auto-renew at the end of each billing cycle unless cancelled before the renewal date. You will be notified before any renewal charge is processed. Refunds, if any, are subject to ChoosePure's Refund Policy.

Users assume full responsibility for decisions made based on ChoosePure content. Our total liability, if any, shall not exceed the amount paid by you to ChoosePure in the 12 months preceding the claim.

ChoosePure reserves the right to suspend or terminate user access without prior notice, remove or restrict content, and revoke report access and community privileges if:

Upon termination, your right to access the platform and its content ceases immediately. Provisions that by their nature should survive termination — including Sections 9 (Intellectual Property), 10 (Indemnification), 11 (Limitation of Liability), 13 (Dispute Resolution & Arbitration), and 14 (Governing Law & Jurisdiction) — shall remain in effect.

13. Dispute Resolution & Arbitration NEW

In the event of any dispute, controversy, or claim arising out of or relating to these Terms or the use of ChoosePure:

13.1 Good-Faith Negotiation

The parties shall first attempt to resolve the dispute informally by contacting support@choosepure.in. Both parties agree to negotiate in good faith for a period of 30 days from the date of the initial written notice.

13.2 Mandatory Arbitration

If good-faith negotiation fails, the dispute shall be resolved by binding arbitration in accordance with the Arbitration and Conciliation Act, 1996 (India). The arbitration shall be conducted in Bengaluru, India, in the English language, by a sole arbitrator mutually appointed by the parties. If the parties cannot agree on an arbitrator within 15 days, the appointment shall be made in accordance with the Act.

13.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action or class-wide arbitration against ChoosePure.

14. Governing Law & Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of India. Subject to the arbitration clause in Section 13, any disputes shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.
